Terms of Service
Version October 2026 · PIT Webservices GmbH, FN 388790 a · English convenience translation – the German version is legally binding.
1. Scope and contracting parties
1.1 These Terms apply to all contracts for the use of mcpbrief.de (the “Service”) between PIT Webservices GmbH, Richard-Wagner-Gasse 16, 2301 Groß-Enzersdorf, Austria (“Provider”) and its customers.
1.2 The Service is open to businesses and consumers. A consumer is anyone who concludes the contract for purposes that are predominantly outside their trade, business or profession (§ 1 Austrian Consumer Protection Act (KSchG), § 13 German Civil Code (BGB)). Towards consumers, these Terms apply only insofar as mandatory consumer protection law does not provide otherwise; provisions that apply only to businesses are marked as such.
1.3 Deviating terms of the customer do not apply, even if the Provider does not expressly object to them.
2. Services
2.1 The Provider enables the sending of physical letters (standard letter, priority, registered mail) to recipients worldwide: the document submitted by the customer is printed, enveloped, franked and handed over to the respective postal service provider – triggered via the web interface, via AI assistants (e.g. Claude or ChatGPT) using the Model Context Protocol (“MCP”) and via API keys. Receiving mail is not offered.
2.2 For printing, enveloping and posting, the Provider uses third parties (in particular Pingen GmbH and its print centres) as well as the respective postal service providers. The Provider’s service for an individual letter is fully performed as soon as the letter has been handed over to the print service provider; printing, enveloping and posting by that provider and carriage by the postal service provider follow. Transit times and delivery are the responsibility of the postal service provider and cannot be guaranteed.
2.3 The dispatch confirmation documents the handover to the postal service provider; for registered mail, the tracking number is also provided. No proof of the content of the letter is provided. The customer is responsible for declarations subject to deadlines – including allowing sufficient postal transit time.
2.3a The Provider lays out the customer’s texts in a letter layout or adds an address sheet in front of finished documents. The customer checks the address and preview before dispatch. Cancellation is only possible as long as the letter has not yet been printed.
2.4 The Provider strives for high availability but does not owe uninterrupted accessibility. Maintenance work and disruptions at third parties are reserved.
3. Registration and access
3.1 Use requires a customer account with truthful details (name or company, address, email). Changes must be updated in the account without delay.
3.2 Login credentials, API keys and connections to AI assistants must be kept confidential. All letters triggered via the account, an API key or a connected AI assistant are deemed to have been initiated by the customer. The customer can revoke connections and keys in the account at any time.
4. Prices, credits and payment
4.1 Sending is charged in prepaid credits. The price list shown at the time of purchase applies. All prices are final prices including statutory VAT; the amount shown is the amount payable. For reverse charge (valid EU VAT ID outside Austria) or customers outside the EU, the same amount is charged without VAT.
4.2 Credit consumption depends on the delivery type, number of pages (including the address sheet), colour printing and destination zone; printing, envelope and postage are included. The price is shown before every dispatch.
4.3 Credits are reserved when the order is placed. If a letter is rejected by the print centre or cancelled before printing, the credits are automatically refunded. No refund is made for letters that are returned as undeliverable after posting. Credits do not expire as long as the customer account exists. Businesses receive no cash payout; consumers are refunded unused, paid credit on request when the contract ends (excluding free and bonus credit).
4.4 Payment is made in advance via the payment service provider Stripe. Invoices are issued electronically.
5. Customer obligations – in particular ban on advertising
5.1 The customer is solely responsible for the content, sender details and recipient address of every letter, even if an AI assistant creates or sends the letter on their behalf.
5.2 Sending mass advertising is prohibited, as is advertising to recipients who have objected to it (including the Robinson list, § 7 German Unfair Competition Act (UWG)), and content that is unlawful, infringes third-party rights, harasses, threatens or contains falsified sender details. Dangerous or prohibited items naturally cannot be sent.
5.3 To prevent abuse, sending limits apply: up to 20 letters on the first day of the account, after which the daily limit doubles with each further day. The Provider may adjust limits in individual cases.
5.4 In the event of reasonable suspicion of violations, the Provider may block the account immediately. The customer indemnifies the Provider against third-party claims arising from use in breach of contract, including reasonable costs of legal defence.
6. Liability
6.1 The Provider is liable only for intent and gross negligence; this does not apply to personal injury. Liability for slight negligence, lost profits, consequential damages, data loss and missed deadlines is excluded.
6.2 Liability is limited in amount to the fees paid by the customer in the last twelve months.
6.3 For consumers, the limitations in 6.1 and 6.2 apply only insofar as permitted by § 6 KSchG and other mandatory law; in particular, liability for personal injury and for damage caused by gross negligence or intent remains unaffected.
7. Data protection and retention
Letter documents are deleted automatically after 30 days. Billing-relevant metadata is stored for the statutory retention period. Details are set out in the privacy policy.
8. Term and termination
The contract runs for an indefinite period and can be terminated by either party at any time by email. The right to extraordinary termination remains unaffected. If the Provider terminates without good cause, unused credit is refunded pro rata.
9. Changes
The Provider may change these Terms with effect for the future. Changes are announced by email at least four weeks in advance; if the customer does not object within this period, they are deemed accepted. The notification will point out this consequence. For consumers, this applies only to changes that do not unreasonably disadvantage them; changes to the main services or prices require express consent.
10. Final provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. For businesses, the place of jurisdiction is the court with subject-matter jurisdiction for Vienna Inner City. For consumers: mandatory consumer protection provisions of the country of their habitual residence remain unaffected; actions against consumers may only be brought at their domicile, habitual residence or place of employment (§ 14 KSchG). Should individual provisions be invalid, the remainder of the contract remains valid.
11. Right of withdrawal for consumers
Right of withdrawal: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded (purchase of credit or payment for a letter). To exercise your right of withdrawal, you must inform us (PIT Webservices GmbH, Richard-Wagner-Gasse 16, 2301 Groß-Enzersdorf, Austria, phone +43 676 3112675, email support@mcpbrief.de) of your decision by an unequivocal statement (e.g. an email). You may use the model withdrawal form below, but it is not obligatory. To meet the deadline, it is sufficient to send your communication before the period expires.
Effects of withdrawal: If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than 14 days from the day we receive your notice, using the same means of payment you used, at no cost to you. If you requested that the service begin during the withdrawal period, you must pay an amount proportionate to what has been provided until you withdrew – i.e. the credit already used for letters sent; unused credit is refunded.
Early expiry: The right of withdrawal expires once the service has been fully performed, if you expressly agreed before purchase that performance may begin before the withdrawal period ends and acknowledged that you lose your right of withdrawal on full performance (§ 18(1)(1) Austrian Distance and Off-Premises Contracts Act, FAGG). A letter counts as fully performed as soon as it has been handed over to the print service provider. This applies in particular to individually paid letters that are sent immediately after payment.
